Throughout Charlie’s legal career, most of his work has been for manufacturing and technology clients, such as manufacturers of organic and inorganic chemicals, engineered products, metals and military ordnance.

His nationwide practice focuses on environmental law and has covered manufacturing facilities and remediation sites in more than 30 states. He provides counsel on a full range of environmental, health and safety compliance matters, enforcement defense, compliance planning and sustainability reporting, and environmental remediation.

As a young partner, Charlie was seconded to a diversified manufacturer to provide day-to-day environmental, health and safety counseling. In recent years, he has provided ongoing environmental legal support to chemical products and engineered products companies that lack in-house environmental legal resources. Charlie is experienced working with client teams including in-house environmental, health and safety professionals and environmental consulting firms.

Environmental Regulatory Experience

  • Counsels on EHS compliance and environmental enforcement defense nationwide for publicly traded companies, including a chemical manufacturer and an engineered products manufacturer.
  • Defense of civil enforcement actions by U. S. Department of Justice under the Clean Air Act, resulting in settlements including Supplemental Environmental Projects.
  • Defense of OSHA citations, including Process Safety Management (PSM) investigations.
  • Counseled on permitting issues and enforcement defense under the Clean Water Act NPDES program, including challenges to TMDLs.
  • Counseled on permitting issues and enforcement defense under RCRA, including permitted unit closures and facility-wide corrective action.

Superfund and Site Remediation Experience

  • Representation of Olin Corporation in Superfund and site remediation matters nationwide.
  • Representation of government contractor manufacturing clients at the CERCLA sites listed below. At each location, the United States sought CERCLA response costs from client and other PRPs, and Charlie countered with demands for contribution from federal agencies including the Department of Defense (DOD) and the General Services Administration (GSA). In the concluded matters, a Husch Blackwell team was able to assign to the United States a share equal to or greater than the clients.’

  • Representation of clients in contribution litigation and private allocation at the Lower Passaic River Study Area Superfund Site, where EPA has recently proposed a $1.7 billion remedy.
