In addition, we regularly assist agricultural borrowers in the negotiation and implementation of their whole loan, multilender term and revolving facilities, including the issuance of the various opinions necessary to facilitate these transactions. Among these clients are agricultural producers, commodities and feed sellers, alternative fuel manufacturers and agricultural equipment leasing companies.
Our agribusiness lending team provides guidance in revolving and term loan documentation, loan protection strategies and borrowing flexibility. Our expertise extends from day-to-day lending questions, to complex tax and regulatory issues. We also provide counsel on construction and permanent debt and equity facilities for projects, including farm improvements, agribusiness facilities, distribution centers and ethanol production facilities.
Our attorneys regularly counsel clients and close financing transactions from coast to coast and internationally. Loan Workout Services
We represent a wide range of lenders and borrowers in all types of agricultural loan workouts, foreclosures and bankruptcies. The experience of our attorneys includes restructuring and foreclosure of general farms, raw land, citrus farms, cranberry farms and cold storage facilities. It is not uncommon for insolvent borrowers to file counterclaims under lender liability theories, and our attorneys have extensive experience defending such claims. Our attorneys have substantial experience in foreclosure, deeds in lieu of foreclosure, replevin and subsequent ownership, management and disposition of a variety of agricultural collateral. We advise clients on a broad spectrum of issues that arise in real estate ownership, including tax consequences, eviction proceedings, title considerations and environmental concerns.
