Persistence Pays in Securing Critical Old Documents

Situation 

A large petroleum and petrochemical distributor faced a $750,000 liability claim for alleged toxic exposures at a Canadian property it sold in 1995. The client had retained no records related to the transaction or the facility, and the relevant documents were so old they were not available on Canadian or U.S. securities agency websites.

Result 

Our team persuaded the provincial securities commission in Canada to locate the documents on microfiche and scan them. With the documents in hand, our attorneys secured a voluntary dismissal of the claim, and our client paid nothing.
