Hospital Construction Proceeds After Lawsuit Dismissed

Situation

Our client, a private multispecialty group practice, was sued by a competing healthcare provider to enjoin the client’s construction of a new hospital and cancer center. The lawsuit claimed that construction of the new facilities breached restrictive covenants. 

Result

Husch Blackwell argued that the covenants did not apply to the parcel of land on which the healthcare facilities were to be built. The Court agreed and granted summary judgment in favor of our client on all issues, allowing construction to proceed.
