Jane E. Fedder

Partner

Jane advises and represents a wide range of clients engaged in all sectors of the economy in the areas of environmental and energy law. She is a skilled and determined advocate for her clients, with whom she partners to obtain timely, cost effective, superior and comprehensive results. Jane particularly excels at tackling complex legal issues and advising on strategic business decisions. She has extensive experience defending clients facing governmental enforcement actions, administrative proceedings and private-party disputes.

With a practice that is nationwide in scope, Jane specializes in prosecuting and defending claims under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and in environmental insurance litigation. Her legal accomplishments include the following:
-- Favorable assertion of the useful product defense against the U.S. Department of Justice and the U.S. Environmental Protection Agency to defeat claims of CERCLA arranger liability.
-- Narrowing the scope of CERCLA officer/shareholder liability.
-- Winning a nonsettling party's right to intervene to challenge entry of a consent decree that unfairly allocated liability among potentially responsible parties.
-- Gaining favorable interpretations of the so-called pollution exclusion clause in comprehensive general liability insurance policies.
-- Preventing insurers who breach duties owed to the insured from asserting coverage exclusions.
Jane is a demonstrated leader in the coordination and implementation of strategy for complex multiparty federal lawsuits, including large joint defense groups, from inception through completion, including case management, motion practice, discovery, alternative dispute resolution, trial, appeals and settlement.

Jane recently completed eight years of service to the Missouri Supreme Court and Office of Chief Disciplinary Counsel on the Attorney Disciplinary Committee for Missouri, Division III, Region X. She frequently consults and advises on professional responsibility/ethical issues and the attorney disciplinary process. She also has a strong commitment to providing pro bono legal services.
